<p>Keep in mind that at any time, a title company can give you an estimate of closing costs, based on the type of title insurance policy (standard or extended) and the purchase price of the home.&amp;nbsp; Here's another list of what each party to a transaction pays for:</p>

]]></description><guid>/website/blog/default.asp?Display=1863</guid><link>/website/blog/default.asp?Display=1863</link><pubDate>Thu, 22 Jul 2010 15:19:21 0000</pubDate></item><item><title>Coos County Land Sale is April 10, 2010</title><description><![CDATA[<p>Periodically, Coos County takes stock of thier land holdings and offers up a few for sale at a public auction.&amp;nbsp; It's a mix of vacant acreage, city lots and&amp;nbsp;homes.&amp;nbsp; The auction will be held at the Coos County Annex Conference Room, 201 N. Adams in Coquille.</p>
<p>At this auction, there will be 14 properties available to bid on, with published minimum bid amounts ranging from $500 to $59,000, the lone exception being a 38.17 acre piece of vacant land in the New River area south of Bandon, which has a minimum bid amount of $800,000.&amp;nbsp; </p>
<p>&amp;nbsp;To bid on properties at the auction, a purchaser must pay for parcels under $5,000 at the close of the auction in either cash, cashiers check or money order.&amp;nbsp; For parcels $5,000 or over, a purchaser must pay a deposit of 20% of purchase price at the close of the auction, and the balance must be paid by April 23, 2010.</p>
<p>Properties are conveyed to the purchaser by a Quitclaim Deed, and Coos County does not offer any warranties.&amp;nbsp; Properties are sold AS-IS.&amp;nbsp; <em>Without exception, Coos County reserves all mineral rights to each property sold at auction.</em></p>

<p>Bandon's Old Town district is a section of loosely six or eight&amp;nbsp;square blocks, comprising the Coquille River front and Hwy 101 frontage.&amp;nbsp; The area sits just west of US Highway 101, and consists of restaurants, gift shops, galleries and service companies.&amp;nbsp; </p>
<p>Five properties are now for sale in Old Town Bandon, several of those having thriving restaurants inside.</p>
<p><strong><span style="color: #003366"><strong style="color: #800000">375 Second Street ($399,000)&amp;nbsp;- Alloro Restaurant ($175,000)</strong> </span></strong></p>

<p>This coffee house and deli, built in 1958, is 2000 square feet.&amp;nbsp; The restaurant is an open floorplan with an outdoor seating area.&amp;nbsp; 14 parking spaces.&amp;nbsp; The price includes land, building, business and equipment.</p>

<p>This property, if it included all three tax lots, would be a good deal. Unfortunately, the listing looks as though only the smallest tax lot and building (40x101) is for sale.&amp;nbsp; This makes it overpriced at best.&amp;nbsp; Quite easily the best Old Town location for a service-oriented buisiness, this is a property to watch.</p>
<p><span style="color: #800000"><strong>480 1st Street ($1,500,000)</strong></span></p>
<p>This is a very large riverfront restaurant building, with three levels, each useful as a bar, restaurant or cafe.&amp;nbsp; The building is approximately 5,000 square feet, and sits on just under 1/4 acre of riverfront land.&amp;nbsp; At the end of 1st Street, this property is directly between the part of Old Town that caters to pedestrians, and the South Jetty Park.&amp;nbsp; Restaurant equipments is included in the sale of this property.</p>
<p><span style="color: #800000"><strong>Arcade Tavern</strong></span></p>
<p>Now this is the gem of Old Town Bandon.&amp;nbsp; Located on the corner of Alabama and 1st Street, the old Arcade Tavern (now bank-owned - see blog entry entitled, <em>Arcade Tavern Goes To Auction</em>) was auctioned in December with a minimum bid amount of $398,058.94, but no one bothered to qualify as a bidder.&amp;nbsp; Yep...not one party even registered to be eligible for the auction.&amp;nbsp; Since the failed auction, the bank has received several offers, and continue to pursue price negotiations with at least one party.&amp;nbsp; When people ask, "Why hasn't anyone bought this yet?" I don't have an answer for them.&amp;nbsp; The fact is, it's in the right location, and at the right price.&amp;nbsp; With a river view, and just steps off the crabbing docks, this property is one that doesn't come around very often.&amp;nbsp; It's not so much the price of this property that makes it valuable, but the fact that it's rare. And in Bandon.</p>

<p>Of particular note is that with one exception, the sold properties in Coos County are priced significantly under $150,000. Again with one exception, these properies are residential.</p>
<p>We keep hearing, even from other real estate professionals, that this is a "lousy market". Here at our office, we're not so sure. There are two sides of eacj real estate market, and this market is an exciting one. Buyers who were priced out of the market in the last five years (especially in the Bandon area of Coos County) are now able to step in and purchase homes. The difference is that these buyers are savvy and informed, making sellers take a hard look at pricing their properties realistically.</p>

]]></description><guid>/website/blog/default.asp?Display=1356</guid><link>/website/blog/default.asp?Display=1356</link><pubDate>Wed, 27 Jan 2010 15:02:57 0000</pubDate></item><item><title>Fire Protection Committee Introduces Itself to Landowners</title><description><![CDATA[<p>There are over 7,000 properties in Coos County affected by the Oregon Forestland-Urban Interface Fore Protection Act of 1997 (Senate Bill 360).&amp;nbsp; Last week, Coos County 's Interface Committee sent notices of a public hearing regarding this act to all affected landowners. <strong>A public hearing will be held February 10, 2010 at 6:30p.m. at the Coquille Community Center, located at 115 N. Birch in Coquille.</strong>&amp;nbsp; The notice states, "Objections, remonstrances or suggestions relating to the proposed classification will be heard at this time.&amp;nbsp; Following the hearing, formal notifications will be mailed to affected property owners."</p>
<p>WHAT PROPERTIES MEET THE GUIDELINES?</p>
<ul>
    <li>Lands within the county that are also inside&amp;nbsp;an Oregon Department of Forestry protection district.
    <li>Lands that meet the state&rsquo;s definition of &ldquo;forestland.&rdquo;
    <li>Lands that meet the definition of &ldquo;suburban&rdquo; or &ldquo;urban&rdquo;; in some cases, &ldquo;rural&rdquo; lands may be included within a forestland-urban interface area for the purpose of maintaining meaningful, contiguous boundaries.
    <li>Lots that are developed, that are 10 acres in size or smaller, and which are grouped with other lots with similar characteristics in a minimum density of four structures per 40 acres. </li>
</ul>
<p>The 1997 Act was initiated as a wildfire prevention measure, and the majority of properties in Coos County do not meet the guidelines to be affected by this initiative.&amp;nbsp; The law is intended for homeowners in wildland urban areas of state-protected forestlands to reduce their risk if a fire occures close to (or on) their property.</p>
<p>&amp;nbsp;The Oregon Department of Forestry will assume administrative responsibility, and notifies the owners of properties within the forestland-urban interface boundaries.&amp;nbsp; <strong>"Property owners have two years after receiving their letter of notification to comply with the fuel-reduction standards described in&amp;nbsp;</strong><a title="OAR Statutes for Forestland-Urban Interface" href="http://arcweb.sos.state.or.us/rules/OARS_600/OAR_629/629_044.html"><strong>OAR 629-044-1050 through 629-044-1085.</strong></a></p>
<p>WHAT IF A LANDOWER DOES NOT COMPLY?</p>
<p>The&amp;nbsp;Oregon Department of Forestry website states that a certification card will be sent to forestland-urban interface property owners, which may be signed and returned to ODF after the fuel-reduction standards have been met.&amp;nbsp; Return of aforementioned card is VERY important for landowners.&amp;nbsp; The return of a certification card&amp;nbsp; relieves a property owner from the Act's fire cost-recover liability.&amp;nbsp; For a landowner without a certification card, the State of Oregon may seek to recover certain fire suppression costs from a property owner if the fire originates on the owner's property, the fuel reduction standards have not been met, and ODF incurs extraordinary suppression costs.&amp;nbsp; The cost-recovery liability is capped at $100,000.&amp;nbsp; A certification card is void when a property sells or a structure is added.&amp;nbsp; It is also void when the land is reclassified.</p>
<p>If you have received a preliminary letter from the Coos County Forestland-Urban Interface Committee, it is in your best interest to visit the <a title="Committee Website" href="http://egov.oregon.gov/ODF/FIRE/SB360/sb360.shtml">website</a>, attend the meeting, and make sure that you know the rules and regulations of this Act.&amp;nbsp; Certification forms can be downloaded from the website as well.&amp;nbsp;Curiously, no information on the Coos County are is available online.&amp;nbsp; Another reason to attend this meeting.</p>

]]></description><guid>/website/blog/default.asp?Display=1348</guid><link>/website/blog/default.asp?Display=1348</link><pubDate>Tue, 26 Jan 2010 15:58:51 0000</pubDate></item><item><title>Arcade Tavern Goes To Auction</title><description><![CDATA[<p>The highly anticipated <a title="Trustee's Notice" href="http://ucbandon.com/virtualoffice_files/Arcade%20Tavern%20Trustees%20Notice%20of%20Sale.pdf" target="_blank">auction of the Arcade Tavern </a>has come and gone, and no one noticed.&amp;nbsp; The former Arcade Tavern sits at the corner of 1st Street and Alabama Ave in Old Town Bandon.&amp;nbsp; From it's front windows, a patron has a view of the busy Bandon boardwalk and boat launch.&amp;nbsp; Those in town crabbing for the weekend would step into the Arcade for a drink between pulling up the crab traps set up on the docks.&amp;nbsp; The location is prime, and many people around town talked of this property as a great investment.</p>
<p>With an opening bid amount of $398,058.94, it seemed that someone would get a decent deal on a fantastic Old Town Bandon location.&amp;nbsp; When I showed up this morning at 9:55, there were five people in front of the Coos County Courthouse. Not exactly the large turnout I expected, given the huge amount of interest I was hearing around Bandon in the months before the auction.&amp;nbsp; When it came time for the auction to begin, auctioneer Matthew Bier, the Delinquent Loan Coordinator from&amp;nbsp;<a title="Chetco FCU" href="https://www.chetcofcu.org/CFCU/home.jsp" target="_blank">Chetco Federal Credit Union</a> stepped up, cleared his throat and announced the property being auctioned.&amp;nbsp; Shortly thereafter, Mr. Bier repeatedly asked if there was anyone interested in qualifying to bid.&amp;nbsp; No one spoke up.</p>
<p>Qualifying to bid on a property being auctioned by Chetco Federal Credit Union simply includes providing proof of funds.&amp;nbsp; When no one&amp;nbsp;qualified to bid, it effectively cancelled the auction.&amp;nbsp; The property now reverts to Chetco Federal Credit Union, which will have it appraised and then determine whether or not to put it on the market.&amp;nbsp; If it goes to market, it's likely that an offer in the amount of the minimum bid would be successful.</p>
<p>In conversation with Mr. Bier&amp;nbsp;after the auction, he indicated that he has little&amp;nbsp;involvement in&amp;nbsp;the fate of the Arcade Tavern now that this morning's auction is finished.&amp;nbsp; He said he was surprised by the lack of interest in the property. &amp;nbsp;Leading up to the auction date, his phone was "...ringing off the hook." with&amp;nbsp;inquiries.&amp;nbsp; He did offer insight into the situation, saying that there was a Federal tax lien against the property.&amp;nbsp; Once a buyer actually purchases the property, the federal government has 120 days in which to purchase the property, plus or MINUS 6% of the price.&amp;nbsp; That means that if the federal government wanted to, they could buy the property for LESS than you did!&amp;nbsp; No one I've talked to understands whether or not the successful bidder would actually lose that 6% or if the entire bid amount would be refunded.&amp;nbsp; Perhaps this is why there was such lack of interest??</p>

]]></description><guid>/website/blog/default.asp?Display=1205</guid><link>/website/blog/default.asp?Display=1205</link><pubDate>Thu, 3 Dec 2009 15:21:36 0000</pubDate></item><item><title>New Landlord/Tenant  Law Changes</title><description><![CDATA[<p>Many changes have come through the&amp;nbsp;<a title="Oregon Legislature" href="http://www.leg.state.or.us/" target="_blank">Oregon Legislature</a> with regard to Landlord/Tenant law.&amp;nbsp; Many items have stayed the same, but some serious changes have come up.&amp;nbsp; This article is to give a very brief overview of the four major changes to law for rental owners and property managers.* The new laws will become effective in January 2010.</p>
<p><strong>Four New Changes:</strong> </p>
<p>Restricts fees a landlord may charge</p>
<p>Requires no-cause notices after the first year of the tenancy to be served at least 60 days in advance of eviction.</p>
<p>Provides a way for landlords to manage personal property when a tenant who lives alone dies.</p>
<p>Allows guests and landlord to arrange for guests&amp;nbsp;to stay in a rental, but not acquire tenant rights.</p>
<p>FEES</p>
<font face="Times-Roman">
<ul>
    <li>
    <div align="left">"All one-time fees, such as cleaning fees, pet fees, carpet cleaning fees, and move-in fees, are prohibited. Fees for service or companion animals are prohibited."</div>
    <li>
    <div align="left">"<font face="Times-Roman">A landlord must provide a written disclosure of rent, deposits, and fees when entering into a rental agreement or, if accepting a deposit under an agreement to rent the property at a future date, when accepting a deposit under that agreement. The parties can agree to amend that list before entering into a rental agreement."</font></div>
    <li>
    <div align="left">"Some fees are still allowed, as long as they are strictly for non-compliance issues:</div>
    <ul>
        <li>
        <div align="left">&amp;nbsp;&amp;nbsp;"<font face="Times-Roman"> [1] late charges;
        <p align="left">[2] for a bounced check, plus any amount the landlord was charged by the bank;</p>
        <p align="left">[3] in a manufactured home, for pet violations;</p>
        <p align="left">[4] unless the landlord chooses to charge for damages, breaking a lease, though limited to</p>
        <p align="left">one and a half times rent;</p>
        <p align="left">[5] late payment of utilities paid to the landlord (not to exceed $50);</p>
        <p align="left">[6] failure to clean up pet waste (not to exceed $50);</p>
        <p align="left">[7] failure to clean up garbage from outside the dwelling unit (not to exceed $50);</p>
        <p align="left">[8] parking violations (not to exceed $50); and</p>
        <p>[9] improper use of vehicles, such as speeding, on the premises (not to exceed $50)."</p>

    </ul>

    <li>
    <div align="left">"Charges for services requested by the tenant and not required by lease or law, such as key replacement and lock-out fees, are not prohibited."</div>
    </li>

<p>NO-CAUSE NOTICES</p>
<font face="Times-Roman">
<ul>
    <li>
    <div align="left">"A landlord&rsquo;s no-cause notice during the first year of occupancy must be a minimum of 30 days, but after the first year of the occupancy must be at least 60 days. 'First year of occupancy' means that all of the current tenants have been there for at least a year.</div>
    <li>
    <div align="left">"For a fixed-term tenancy of at least one year that by its terms converts to a month-to-month tenancy, the landlord may use a 30-day notice during the 30 days prior to the conversion date, but must use a 60-day notice after that date."</div>
    <li>
    <div align="left">"A no-cause notive may give an explanation of the reason for the termination without making it a for-cause notive, as long as the notice contains certain wording."</font><font face="Times-Roman"><font face="Times-Roman"></div>
    </li>
</ul>

<p align="left">DECEASED TENANT LIVING ALONE</p>

    <div align="left">"This arrangement must be in writing signed by the three parties. The agreement must contain certain language."</div>
    </font><font face="Times-Roman">
    <li>
    <div align="left">"The landlord may screen the temporary occupant for behavior-related issues, such as getting criminal records and checking with prior landlords about behavior, but may not screen for credit or income or rent payment history."</div>
    </font><font face="Times-Roman">
    <li>
    <div align="left">"The agreement can have an ending date."</div>
    </font><font face="Times-Roman">
    <li>
    <div align="left">"The arrangement can be terminated at any time without cause by the tenant; it can only be terminated for cause by the landlord. If it is a month-to-month tenancy, the landlord can terminate the tenancy (which would effectively terminate the temporary occupant agreement) without cause."</div>

<p>Bandon's Old Town merchants,&amp;nbsp;<a title="Bandon Chamber" href="http://www.bandon.com/" target="_blank">Chamber of Commerce</a> members, media and citizens met on Monday at the <a title="Barn" href="http://www.ci.bandon.or.us/barn.htm" target="_blank">Barn </a>to become for informed about this exciting <a title="Main Street Meeting Flyer" href="http://ucbandon.com/virtualoffice_files/Main%20Street%2011-9-09.pdf" target="_blank">new program</a>.</p>
<p>Attempts have been made to revitalize city centers nationwide in the past, only to fail and leave towns blighted by vacant buildings and failing businesses.&amp;nbsp;Urban renewal sought to eliminate old and tired buildings with new, clean facades, but backfired when all the personality of those old buildings was lost to cold and lifeless cookie-cutter downtown areas.&amp;nbsp;Downtown pedestrian malls were created by blocking off motor vehicle traffic, but businesses suffered (and ultimately relocated) when the pedestrians never showed.</p>

<div>We recently discovered that the shop attached to our home was leaking due to improperly installed siding, which caused some water damage in the wall surrounding the windows. &amp;nbsp;Since the walls have no sub-siding, we opted to replace the existing T1-11 with new T1-11. &amp;nbsp;That's when we discovered that it pays to shop around.</div>

<div>We called five different builder's supply stores in Coos County, realizing that a 30 minute drive might be necessary. &amp;nbsp;We asked for 12 sheets of 4'x8' grooveless T1-11 siding, 5/8" thick. &amp;nbsp;</div>
